After Nintendo took action on October 30, it was announced that the unauthorized video on the NFT 1Up betting platform using Super Mario footage had been removed from YouTube. It is understood that 1Up uses patents, including the classic Mario Bros. (Mario Elf), in racing games that allow people to compete with their own NFTs for in-game cash. In a blog post by September 2021 (discovered by Kotaku), 1Up claimed it would “bring Mario and his friends to the blockchain,” even without Nintendo's cooperation or approval. (NME)
